4.8. Failure To Identify To A Peace Officer

  • A person who, while being detained or under arrest by a peace officer, fails to provide a peace officer or other legal authority their name as it appears on an I.D. card or other identifiable information for MDC purposes.

- Penal Code (4)08 is a misdemeanor punishable by a maximum of 10 months imprisonment and no more than $150 in fines. This falls under Officer Discretion.

NOTES:

As per (12)11. Maximum Imprisonment someone who fails to identify and provide a way to properly charge them will be imprisoned 900 months until they identify themselves, after which this charge, plus all applicable charges, can be placed on their record and their sentence adjusted.
